Conditions for the execution of works

1. The ordering party orders, and the Contractor accepts the order for execution

2. Order execution will be preceded by appropriate measurements by the Employer on the Employer’s facilities and preparation of the balustrade design by the Contractor. The project will also include arrangements between the parties, so it is very important to check the arrangements by the ordering party and the compliance of the project, because on its basis individual elements will be produced that cannot be changed/improved after their production.

3. SUBJECT OF THE CONTRACT :
Execution of railings in accordance with the designs sent after measurements and accepted by the customer and the offer with the oldest date (sent by e-mail)

4. TIME LIMIT FOR COMPLETION :
The implementation of the balustrade design will take place within 7 weeks from the moment of accepting the designs and paying the required advances/payments. Random situations are not the contractor’s fault and may affect the completion date.

5. ADVANCES/PAYMENTS FOR THE ORDER:
I Advance payment for commencement of execution 30% of the value of the order, not less than PLN 1000
II Payment of the remaining amount of the total value of the order – before unloading the goods.

6. Proforma invoice, drawings (projects) accepted by the Ordering Party constitute an integral part of the contract.

7. Basis for recalculation   offer (Proforma Invoices) is a design made by the Contractor. The recalculated offer will be consistent with the facts.

8. The order will be fulfilled on the basis of the project approved by the ordering party, which we will send to the ordering party after the measurements made by the ordering party, the ordering party is obliged to consult the project with individual contractors at its construction site who have an impact on the size of the place where the railing is to be placed.

9. The Ordering Party is obliged inform you about changes between the survey and measurements, if any. In the case of changes of which the Contractor will not be informed and they will affect the order, additional costs shall be borne by the ordering party.

10. The Ordering Party is obliged to informing the contractor about the possibility of entering the construction site or not, if the contractor has previously reported that he intends to come with the goods.

11. The value of all the Contractor’s work related to the proper execution of the order and the materials used have been calculated and included in the proforma invoice, which is an integral part of the contract. Increasing the scope of work, changing the amount of materials used, changing design assumptions are factors that affect the price and are the basis for re-calculation of the order.

12. During the execution of the order, the Contractor receives access to the facilities for a team of own employees, and all arrangements related to the preparation of the subgrade by the Employer have been completed. The Employer shall provide the contractor with a parking space and a place where the material can be safely unloaded.

13. The contractor bears full responsibility for own employees in the field of health and safety protection during the performance of the order on the Employer’s construction facilities.

14. The Purchaser will make the payment for individual stages of the Contractor’s work, and the Contractor shall issue appropriate documents confirming these payments.

15.For the work done and the material used, the Contractor grants the Ordering Party a 1-year warranty.

16. The welds of the structure are visible. After galvanizing, you can see the welding spot.

17. With point pressure, the panes can bend in accordance with the standards – the deflection depends on the thickness of the glass, its size and the force of pressure.

18. Niedostatek niewidoczny z odległości 2 metrów nie jest wadą produktu.

19. Towar do momentu zapłacenia przez Zamawiającego pozostaje własnością Wykonawcy i nie podlega reklamacji.

20. Wyrażam zgodę na bezpłatne sfotografowanie obiektu. Jednocześnie wyrażam zgodę na nieodpłatne wykorzystanie dla potrzeb RAPDACH Sp. z o.o. materiałów zdjęciowych z zachowaniem nienaruszenia prywatności oraz zachowania anonimowości właściciela obiektu.

21. Sądem właściwym do rozstrzygania sporów jest sąd w Nowym Sączu.

Conditions for the implementation of the balustrade with assembly on the side of the RAPDACH company

1. The Ordering Party commissions, and the Contractor accepts an order with a specific number for execution

2. Execution of the order preceded will be making the appropriate measurements by the Contractor on the Employer’s facilities and preparing the assembly project. The project will also include arrangements between the parties, so it is very important to check the arrangements and compliance of the project, because on its basis, individual elements will be produced that cannot be changed/improved after their production.

3. SUBJECT OF THE CONTRACT:
Execution and assembly of railings in accordance with the submitted after measurements and accepted designs and offer (email contact)

4. TIME LIMIT FOR COMPLETION :
The project will be implemented within 7 weeks from the moment of accepting the projects and paying the required advances/payments. Delay in the preparation of the front of the works (place of the contract) by the ordering party for the assembly of railings results in the extension of the assembly deadline. Random situations are not the contractor’s fault and may affect the completion date.

5. ADVANCES/PAYMENTS FOR THE ORDER:
1st advance payment for commencement of execution 30% of the value of the order, not less than PLN 1,000
2nd advance payment for imported materials and employee delegation costs (before unloading the goods at the construction site)
III payment for completed orders (assembly) – payable after completion of work

17. The mounting surface should be simple, if it is not otherwise, the contractor will make every effort to perform the assembly so that the whole thing comes out aesthetically. We do not take responsibility for the unevenness of the walls and the substrate previously prepared by the customer.

18. The contractor sets the balustrade horizontally , at the customer’s request, the balustrade can be sloped in accordance with the curvature of the balcony. This should be taken into account in the drawings.

19. With point pressure, the panes can bend in accordance with the standards – the deflection depends on the thickness of the glass, its size and the force of pressure.

20. Scarcity invisible from a distance of 2 meters is not a product defect.

21. The Employer will provide the fitters access to the toilet and electricity at your own expense.

22.Ordering Party or authorized person by Him, undertakes to stay at the assembly site at the end of the work. During the absence of the Employer or a person authorized by him, he authorizes the Contractor to unilaterally accept the works.

23. The goods remain the property of the Contractor until payment by the Ordering Party and are not subject to complaint.

24. I consent to the object being photographed free of charge. At the same time, I consent to the free use for the needs of RAPDACH Sp. z o. o. photographic materials without infringing the privacy and anonymity of the owner of the facility.

25. Competent court disputes are settled by the court in Nowy Sącz.

26. In accordance with point 17 the mounting location should be prepared for proper installation. In the event of a situation in which a Rapdach employee performs activities not related to the direct installation of Rapdach products, the cost of a man-hour of one employee, i.e. PLN 150 net, is covered by the CONTRACTING PARTY

27. The Ordering Party authorizes the Contractor  to issue VAT invoices without the obligation to sign.
